How else are users protected and what are their rights?
These resources offer additional protections and may be useful in learning more about user privacy rights:

California Online Privacy Protection Act (CalOPPA)
CalOPPA is the first state law in the nation to require commercial websites and online services to post a privacy policy. The law’s reach stretches well beyond California to require a person or company in the United States (and conceivably the world) that operates websites collecting PII from California consumers to post a conspicuous privacy policy on its website stating exactly the information being collected and those individuals with whom it is being shared, and to comply with this policy.

The college complies with CalOPPA and agrees to the following:

    • Users can visit the college website anonymously.
    • Once this Privacy Policy Statement is created, a link to it will be added to the colleges website homepage or at a minimum on the first significant page after entering the website, and will be appropriately maintained thereafter.
    • The college’s Privacy Policy Statement link will include the word ‘Privacy’ and can be easily be found on the page specified above.
    • Users will be notified of any Privacy Policy Statement change on the Privacy Policy Statement webpage.
    • Users are able to change their personal information by logging into their my.btech.edu account.

Children Online Privacy Protection Act (COPPA)
When it comes to the collection of personal information from children under 13, COPPA puts parents in control. The Federal Trade Commission, the nation’s consumer protection agency, enforces the COPPA Rule, which spells out what operators of websites and online services must do to protect children’s privacy and safety online. The college does not specifically market to children under 13.

Fair Information Practices Principles (FIPPs)
FIPPs form the backbone of privacy law in the United States and the concepts they include have played a significant role in the development of data protection laws around the globe. FIPPs provide a framework of principles for balancing the need for privacy with public policy interests. Understanding FIPPs and how they should be implemented is critical to comply with the various privacy laws that protect personal information.

In order to be in line with FIPPs, should a data breach occur, the college will notify users via in-site notification within 1 business day.

Individual right to redress
The college agrees to the individual redress principle, which states that individuals have a right to pursue legally enforceable rights against data collectors and processors who fail to adhere to the law. This principle recognizes not only that individuals have enforceable rights against data users, but also that individuals have recourse to courts or government agencies to investigate and/or prosecute non-compliance by data processors.

Controlling the Assault of Non-Solicited Pornography and Marketing Act (CAN SPAM Act) and use of messaging
The CAN-SPAM Act is a law that dictates a range of requirements for emails and other messages from commercial entities, like businesses, marketers, and nonprofit organizations. Emails subject to the law must follow rules regarding subject lines, disclosures, and headers. Further, the law establishes the right of recipients to request removal from email lists.

The college collects email address information primarily to communicate with users regarding business-related matters. Emails can be transactional, informational, or instructional in nature.

The college may also use email information to send marketing materials to its users.  A user may unsubscribe from receiving future emails at any time by emailing the college at unsubscribe@btech.edu. Users will be promptly removed from marketing correspondence once a request to unsubscribe is received.
